Is This Your First Offense?
Drug court programs can be beneficial for first offenders. I can enroll you in a drug counseling program to show the judge that you are taking the charge seriously. It also demonstrates that you are sorry for your actions, and can help make a positive impression on the judge.
Plea In Abeyance
Depending on the circumstances of your charge, you could benefit from a Plea In Abeyance (PIA). In these situations you enter a guilty or no contest plea to your charge. Your plea is then suspended and you are given probation — as long as you meet conditions set up by the judge and prosecutor. As long as you comply with the conditions during your probation your case gets dismissed. Typical conditions for PIAs:
- Completing a counseling program
- Paying fines
- Fulfilling community service
The key to your PIA is that your charges are eventually dismissed. You do not have to worry about going to jail and possibly losing your job. The downside to a PIA is that you officially entered a guilty plea with the court.
If the prosecutor can establish that you violated your conditions, the prosecutor can enter the conviction into record. You are then immediately subjected to all of the consequences of your charge.
